Here is a copy of my seven part Motion for Partial Summary Judgment I filed in my California Open Carry Federal Civil Rights Lawsuit, Nichols v. Brown, on Friday November 8, 2013. Unlike the Attorney General’s briefs, the Intake Clerk and the Magistrate Judge review my briefs for non-compliance before entering them into the record. As a result, my motion was not entered until the next Friday November 15, 2013.
The pdf of my motion is 296 pages long. It has taken me nearly two years to get to this point (my case was filed on November 30, 2011) and if you turn to page 294 paragraph 81, you will note that I close my motion with a quote from the infamous Dred Scott decision which is particularly apt as the sole reason California’s 1967 ban on Loaded Open Carry was passed was to disarm minorities.
