Update by Charles Nichols, President of California Right To Carry – March 21, 2016 –  SCOTUS denied the cert petition without explanation.  This is what happens when one challenges a law (actually a “regulation”) which involves “sensitive” places (government buildings) which the decision in Heller said were presumptively lawful before one firmly establishes the right to carry in non-sensitive public places.  Congress can, of course, remove that “regulation.”

Update by Charles Nichols, President of California Right To Carry – March 18, 2016 –  SCOTUS did not grant the case this afternoon which means we have to wait until Monday to find out what, if anything, happened with the cert petition today.

Update by Charles Nichols, President of California Right To Carry – February 24,  2016 –  This case was today scheduled for the Conference of March 18, 2016.  Given that the cert petition does not identify a SCOTUS Rule 10 split, the cert petition will almost certainly be denied in the Orders list published the following Monday.

Update by Charles Nichols, President of California Right To Carry – January 22,  2016 – I’ve uploaded the Brief amici curiae of Firearms Owners Against Crime and Firearms Industry Consulting Group today.  As its author correctly observed in his email to me, the brief is short because the brief focuses on supporting why the petition should be granted and not on the merits of the case.

As we all know by now, SCOTUS doesn’t grant Second Amendment cases based on their merits.  If the petition does not persuasively argue why the petition should be granted under SCOTUS Rule 10 then it will be denied.

Update December 8, 2015 by Charles Nichols – President of California Right To Carry – Bonidy finally got around to filing his cert petition and none too soon.




Bonidy lost his appeal and the government won its cross-appeal 13-1374 and 13-1391 10th Circuit.  Here is the published decision -> 13-1374 from June 26, 2015.

Bonidy brought this lawsuit seeking to carry a gun in a remote, rural post office and in the adjacent post office parking lot.  The district court judge held that he could carry his firearm in the parking lot but not in the post office building.  Both Bonidy and the Post Office filed an appeal.  The court of appeals reversed the portion of the decision in Bonidy’s favor and upheld the portion of the decision in favor of the USPS.  Bonidy is petitioning for a rehearing.  If the petition is denied, or he loses at the rehearing then his last recourse is the US Supreme Court.

Update by Charles Nichols, President of California Right To Carry – September 9,  2015 – Today, the 10th Circuit Court of Appeals denied the petition for rehearing en banc and did so without a single circuit judge writing a dissent.  Bonidy now has 90 days within which to file a cert petition with SCOTUS.  Let us hope that his attorney writes a cert petition which argues that this decision creates a circuit split instead of just arguing that the decision was in error.  As the SCOTUS rules clearly state, SCOTUS doesn’t grant cert petitions in order to correct errors of the lower courts.  SCOTUS grants cert petitions to resolve circuit and/or state court splits on the interpretation of Federal law.

Update July 21, 2014 – The district court said that Open Carry is the right guaranteed by the Constitution and held that the US Post Office must allow Bonidy to have a firearm, his handgun, in the parking lot but could prohibit him from possessing a firearm inside of the post office.  Both sides filed an appeal.  In the appeal briefs Bonidy argues that the district court was wrong about Open Carry being the right (Bonidy has a concealed carry permit).  Oral arguments have now been scheduled.
