Here are my views on the denial of cert.

Here is the dissent to the denial of cert written by Justice Thomas to which Justice Scalia joined.

Jackson v. San Francisco is the NRA lawsuit challenging San Francisco’s ordinance which requires firearms to be kept locked up in the home or disabled by a trigger lock when not being carried in the home.  A preliminary injunction was denied.  This appeal is the appeal of the denial of that preliminary injunction, the district court proceedings were stayed pending the appeal.  Most of the briefs can be found at the NRA lawyer’s website here.  Here is a link to the Complaint.  Cert was denied, the case resumed in the district court, the Plaintiffs filed a request to dismiss their case in the district court on August 31, 2015.  The judge granted their request on September 3, 2015.  This case is over.  San Francisco won.

Update September 4, 2015 by Charles Nichols – President of California Right To Carry – Yesterday, District Court Judge Seeborg signed the proposed Order making it official.  The Plaintiffs have dropped their lawsuit against San Francisco.  The case is closed.

Update September 1, 2015 by Charles Nichols – President of California Right To Carry – Pursuant to the Order of the court dated August 14, 2015, the Plaintiffs filed an Unopposed Request to Dismiss Case and a Proposed Order to Dismiss the Case under Federal Rule of Civil Procedure Rule 41(a)(2).  Unless the district court judge decides otherwise, the dismissal is without prejudice which means that the Plaintiffs can refile their lawsuit at a later date.  If the district court judge decides to dismiss the case with prejudice then the Plaintiffs would have to file an immediate appeal of the dismissal with prejudice.  If they did not appeal then the Plaintiffs would not be able to challenge the law in the future.  This lawsuit was filed on May 5, 2009.  Between the initial filing of the Complaint and the Unopposed Request by the Plaintiffs to dismiss the case there are 167 docket entries (inclusive) and the lawsuit never made it past the denial of a preliminary injunction and that took over six years.

Unless the current US Supreme Court indicates a willingness to hear Second Amendment cases absent a circuit split for the justices to resolve, the lower courts will continue to pretend the Heller and McDonald decisions never happened.  If Stare Decisis did not apply to this case then there is no such thing as Stare Decisis.  The inferior courts are free to ignore binding precedents.

Fortunately, if I should lose my California Open Carry case on appeal then my loss will create multiple circuit splits, and not just on the Second Amendment.  Were SCOTUS to deny my cert petition then the only thing left to conclude is that the high court is done with the Second Amendment.

Update August 19, 2015 by Charles Nichols – President of California Right To Carry – The district court judge issued an Order dated August 14, 2015, ordering the Plaintiffs to either dismiss their case or for the parties to file a joint statement on what remains to be decided and how the case should proceed.

Despite my contempt for the NRA, the first part of this order is outrageous.  A denial of cert carries no precedential weight.  A denial of a preliminary injunction being upheld by the court of appeals doesn’t mean anything other than the court of appeals does not think that the a preliminary injunction is warranted under the 4-point test used in this circuit.  A preliminary injunction is just that, preliminary.  A denial of a preliminary injunction doesn’t mean that the party seeking the preliminary injunction will not prevail in final judgment nor does having been granted a preliminary injunction mean that the party which obtained the preliminary injunction will prevail on final judgment, let alone on appeal.

District court judge Richard G. Seeborg is an Obama nominee.  Obama has a much better track record of nominating leftist judges who have adhered to their leftists beliefs after being appointed to the bench than any other Republican president’s track record of nominating “Conservative” judges whose conservatism seems to have dissolved the moment they put on the robe.

 

Update August 13, 2015 by Charles Nichols – President of California Right To Carry – There has been no activity on the district court docket since June 15, 2015 when the U.S. Supreme Court Notice that the petition for a writ of certiorari was denied was posted.  I have no idea what will happen next.  I am not familiar with the local rules of the Northern District of California where this lawsuit was filed but eventually the Plaintiffs will have to do something or their case in the district court will be dismissed for failure to prosecute.

Update June 8, 2015 by Charles Nichols – President of California Right To Carry Jackson v. San Francisco has been denied cert because there is no circuit split.  Justices Scalia and Thomas wrote a scathing dissent of the denial which can be found at the end of the Orders list for today.  As this was a preliminary injunction appeal the case now goes back to the district court for a final decision.  If Jackson loses again in the district court and loses again in the 9th Circuit Court of Appeals then the cert petition will undoubtedly be denied again.

It is a sad fact that lower courts can completely disregard a US Supreme Court decision and the High Court won’t grant a cert petition to correct the lower court’s error of law.  Instead, SCOTUS waits for at least two circuits to disagree before granting cert petitions, except when it doesn’t want to wait.  Four votes were necessary to grant the cert petition.

San Francisco has been relisted for the conference of June 4th.  The results of that conference will be available on Tuesday, June 8th.  June 4th will mark its 7th conference.  It is safe to say that at a minimum, the court is taking a close look at this case which is a bit surprising as this is the appeal of a denial of a preliminary injunction.  SCOTUS usually, but not always, waits for a case to have been decided with finality in the lower courts.

Update May 26, 2015 by Charles Nichols – President of California Right To Carry Jackson v. San Francisco has been relisted for the conference of May 28th.  The results of that conference will be available on Tuesday, June 1st.  May 28th will mark its 6th conference.  It is safe to say that at a minimum, the court is taking a close look at this case which is a bit surprising as this is the appeal of a denial of a preliminary injunction.  SCOTUS usually, but not always, waits for a case to have been decided with finality in the lower courts.

Update May 18, 2015 by Charles Nichols – President of California Right To Carry – Jackson v. San Francisco has been relisted for the conference of May 21st.  The results of that conference will be available on Tuesday, May 26th.

Update May 18, 2015 by Charles Nichols – President of California Right To Carry – Jackson v. San Francisco does not appear on the orders list just released.  According to ScotusBlog this means that the case has likely been relisted but we won’t know until the electronic docket is updated.  A relist is better than a denial.  If this case has been relisted the next conference on May 21st will mark its fifth conference and fourth relist.  This past term, SCOTUS has not granted any cases that were not relisted.  Drake v. Jerejian was reviewed in conference three times before being denied.  The Woollard and Kachalsky cert petitions were denied outright after their first conference.  I’ll post an update when the electronic docket is updated which could be today or three days from now.

Update May 4, 2015 – Being relisted for the next conference is better than being denied.  The cert petition has been distributed for Conference of May 14, 2015.  That will be its fourth conference and third relist.

Update May 1, 2015 the case was heard in conference today.  We will not know until Monday whether or not the cert petition was granted, denied, or relisted for the next conference on May 14, 2015.

Update April 27, 2015 the case has been scheduled for the conference of May 1, 2015.  As I mentioned in my previous update, being relisted is better than being denied cert outright.  The relist weighs heavier in favor of Jackson because his is an appeal of the denial of a preliminary injunction.

Update April 25, 2015 –  An interesting factoid is of the 67 cases SCOTUS has granted cert this term, all but ten were scheduled for conference two or more times.  Monday is Jackson’s second conference.  Certainly not a guarantee of being granted cert but it beats not surviving its first conference as have so many thousands of others this term alone.  When a cert petition is granted it usually involves a circuit split, either between the Federal circuits or states (on Federal questions) as described in SCOTUS Rule 10(a) & (b) below.  The ten cases that were granted cert this term without being rescheduled fell into a different category as described in Rule 10(c) below (an important question that has not been decided).  This case, Jackson v. San Francisco also falls into the category as described in Rule 10(c) below – The 9th circuit decided an important federal question in a way that conflicts with relevant decisions of SCOTUS.  Caveat!  As this is the appeal of the denial of a preliminary injunction SCOTUS may simply conclude that the 9th Circuit should be left to decide when preliminary injunctions should or should not be issued and the appropriate time to consider granting cert would be when the case is before it after final judgment has been issued in the case.  I suspect that will happen on Monday.  I hope I’m wrong but one does not need a crystal ball to know the probability of Jackson v. San Francisco being granted cert, particularly at this stage, is somewhere between nil and none.

Rule 10. Considerations Governing Review on Certiorari
Review on a writ of certiorari is not a matter of right, but of judicial discretion. A petition for a writ of certiorari will be granted only for compelling reasons. The following, although neither controlling nor fully measuring the Court’s discretion, indicate the character of the reasons the Court considers:

(a) a United States court of appeals has entered a decision in conflict with the decision of another United States court of appeals on the same important matter; has decided an important federal question in a way that conflicts with a decision by a state court of last resort; or has so far departed from the accepted and usual course of judicial proceedings, or sanctioned such a departure by a lower court, as to call for an exercise of this Court’s supervisory power;

(b) a state court of last resort has decided an important federal question in a way that conflicts with the decision of another state court of last resort or of a United States court of appeals;

(c) a state court or a United States court of appeals has decided an important question of federal law that has not been, but should be, settled by this Court, or has decided an important federal question in a way that conflicts with relevant decisions of this Court.

Update April 24, 2015 –  The decision on whether or not to grant the cert petition or to reschedule it for another conference was made today.  Unfortunately, we will not know until Monday what was decided.

Update April 20, 2015 –  The cert petition has now been scheduled for the Conference of April 24, 2015.  The probability is that the cert petition will be denied for a number of reasons.  1) SCOTUS rarely grants cert, 2) SCOTUS did not request that a brief in opposition be filed, 3) SCOTUS even more rarely grants cert when it is a preliminary injunction which is being appealed, 4) SCOTUS rarely grants cert unless there is a circuit split.  Although the denial of the preliminary injunction is clearly in error, SCOTUS doesn’t grant cert in order to correct errors.  It grants cert in order to resolve circuit splits.  That said, I very much hope that SCOTUS grants cert in this case.  Not to do so would be a signal to the lower courts that there are no longer five justices on the US Supreme Court willing to defend the Second Amendment.

Update April 16, 2015 – An interesting development.  The cert petition was scheduled to be reviewed in conference tomorrow in order to decide whether or not to grant the cert petition.  Today, the case was rescheduled without giving a date certain for it to be reviewed in conference.  Hopefully, this means that the court is giving it a very close look.  The briefs can be found here.

Update April 1, 2015 – The SCOTUS docket shows that the petition was finally assigned to a conference today, the conference of April 17th.  Unfortunately, SCOTUS never asked for a brief in opposition which invariably means that the cert petition will be denied.  When the cert petition is denied the stay in the district court proceedings will be lifted and the case will continue to be litigated before the district court until one of the sides makes a dispositive motion and it is granted.  At that time the appeal process will begin again.  First with the 9th Circuit Court of Appeals and then a cert petition to SCOTUS.

Update March 24, 2015 – The SCOTUS docket shows that the response was filed on the 13th but curiously, there has been no activity since.

Update March 17, 2015 – The SCOTUS docket has not been updated.  The Response to the Petition (which SCOTUS never requested) was due on the 13th and was presumably filed as it was the City which asked for the extension to file its Response which was optional.  If the cert petition is denied, which is likely, the stay in the district court will be lifted and the case will resume until there is a final judgment by the district court judge at which point the appeal process begins anew.  If the Plaintiffs lose their appeal of final judgment before the 9th Circuit, which is likely, and SCOTUS turns down their cert petition then the Second Amendment is dead given the makeup of the current court.  The San Francisco ordinance is a slap in the face to even the narrowest reading of the Heller decision.

Update February 20, 2015 – The briefing schedule has not changed.  SCOTUS never requested a response which means that the cert petition will likely be denied.

Update February 3, 2015 – The US Supreme Court, on January 30th, extended the time to file a response to the petition to and including March 13, 2015.  The prior due date was February 13th and with no request by SCOTUS to the respondents to file a brief, the cert petition was as good as dead.  Now we wait some more to see if SCOTUS requests a response prior to this case being reviewed in conference as to whether or not to grant cert.

Update November 8, 2014 – Here are the latest docket entries:

Update September 29, 2014 – Justice Kennedy routinely extended the time for the NRA to file a cert petition which is now due on November 14, 2014.  This is truly a “Hail Mary” act on the part of the NRA.  Cert petitions are almost never granted, even on decided cases, granting a cert petition on a temporary injunction is even less likely.

Update August 5, 2014 – The mandate was issued on July 28, 2014.

Update July 21, 2014 – The petition for an en banc hearing was denied.  Not a single judge voted to hear the case en banc.  The case continues in the district court.  There is an option to file a cert petition with SCOTUS but these are rarely granted for preliminary injunctions.
