Birdt v. San Bernardino Sheriffs Department

This is another CCW case still in district court.  The case is brought pro se by attorney Jon Birdt.  He sought a TRO based on the Peruta decision which was denied because the district court said it was premature to cite Peruta because the decision could be stayed.  The 9th Circuit Court of Appeals subsequently stayed the issuance of the mandate in Peruta.  Ironically, the magistrate judge cited Peruta extensively in recommending to the district court judge that my case (Nichols v. Brown) be dismissed with prejudice and she did so three weeks after the Peruta decision was stayed.

Jon Birdt is an attorney representing himself.  As of March 25, 2016 the district court has informed Mr. Birdt seven times that his filings have been deficient.  The district court docket in my California Open Carry lawsuit was 173 entries long and in all that time the court did not file a single notice of deficiency against me or the lawyers representing Governor Brown, Attorney General Harris, or the Redondo Beach defendants.

That is zero notices of deficiency filed in my case in which the other side had seven lawyers and all but two of my filings were written and filed by me.

Perhaps Mr. Birdt should hire a lawyer?

Update by Charles Nichols, President of California Right To Carry – August 15,  2016 –  Given that the Full Court petitions were denied today in Peruta v. San Diego and Richards v. Prieto, it shouldn’t be long now before the district court judge issues his ruling against Birdt and closes the case.

Update by Charles Nichols, President of California Right To Carry – August 13,  2016 –  On August 8, 2016, the magistrate judge issued his report and recommendation which recommended that this case be dismissed with prejudice.  The district court judge will almost certainly adopt the report and recommendation.  The plaintiff in this case, attorney Jon Birdt thinks that the Peruta en banc decision which held that there is no right to carry a weapon concealed in public means that he is entitled to a concealed carry permit.

RECOMMENDATION IT, THEREFORE, IS RECOMMENDED that the District Court issue an Order: (1) accepting this Amended Report and Recommendation; (2) granting Sheriff McMahon’s Motion to Dismiss the Second Amended Complaint and Rule 15(d) Supplement (Dkt. 92 and 137); (3) granting Sheriff McMahon’s request for summary judgment; (4) denying Plaintiff’s Motion for Summary Judgment (Dkt. 90) and request for an order requiring Sheriff McMahon to issue a concealed weapon license; and (5) directing that Judgment be entered in favor of Sheriff McMahon dismissing this action with prejudice.

Update by Charles Nichols, President of California Right To Carry – August 5,  2016 – Nothing new.  The district court has 120 days from the filing of a motion to rule on a motion.  The stay in the case complicated things but the clock should have started ticking no later than June 30th, the deadline the court gave to file the supplemental briefs regarding the Peruta decision.  That alone should have started the clock ticking on June 17th.  Regardless, it is the parties to the case who are supposed to file a joint notice informing the court that the 120 day deadline has come and gone.

Update March 25, 2016 by Charles Nichols – President of California Right To Carry – It had been nearly five months to the day that I last checked the status of this case which had been stayed eight and a half months ago.  Since then a few things have happened: Dkt # 143 – Judge Phillips has a new courtroom.  The eponymous Mr. Birdt filed a motion to lift the stay (Dkt #144) which was terminated for a host of reasons (Dkt # 145).  Mr. Birdt’s motion to lift the stay was stricken from the record due to its numerous defects and Mr. Birdt was ordered to try again (Dkt #146).  Mr. Birdt again filed a motion to lift the stay of his case (Dkt #147).  The magistrate judge assigned the hearing on the motion to himself (Dkt #148).

Update April 22, 2015 – Well, as of 2:15pm there have been no new filings since March 10th.  Unless something is filed by 11:59pm tomorrow night, or the court changes its mind, the case will be taken under submission for a decision tomorrow.  It is still hard to believe that the defendants did not file a notice that the Peruta decision has been vacated.

Update April 2, 2015 – Incredibly, the defense has NOT filed a notice that the Peruta decision has been vacated.

Update March 11, 2015 – The district court issued an Order on Monday saying it will take the case under submission for a decision no later than April 23, 2015.  The lawsuit was filed on 04/12/2013.

Dkt #140 – “On March 6, 2015, Defendant John McMahon filed a Motion to Dismiss Second Amended Complaint (“Motion”). Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds that this matter is appropriate for decision without oral argument. The hearing scheduled for April 14, 2015, is hereby vacated and the matter is taken off calendar. Plaintiff shall file his opposition to the Motion no later April 9, 2015, Defendant may reply to the opposition no later than April 23, 2015. Update February 4, 2015 – The plaintiff, Jon Birdt, filed a document on January 30, 2014 wherein he notified the court that he had once again been denied a CCW by the Sheriff.  Attached was a letter from the Sheriff saying that he had been denied but refused to tell him the reason for the denial citing California Government Code section 6254(f).  However, California Penal Code sections 26202 and 26205 both require that the reason for the denial be stated.

Update October 3, 2014 – This is another mess of a case.  There has been lots more activity but it has now been resolved after one year, five months and 20 days of litigation that the Sheriff of San Bernardino has denied Birdt’s concealed carry permit because Birdt fails to satisfy the “good moral character” requirement of the statute.  The court has determined that now is the time for the parties to file briefs addressing the appropriate level of scrutiny for denial of Birdt’s application for a concealed carry permit.  The briefs are due on November 1, 2014.  Here is a link to Dkt # 122.

Update September 23, 2014 – Lots more activity.  The magistrate judge has issued a report and recommendation to which an objection and reply has been filed.  In a nutshell, this is where the case now stands if the district court judge adopts the report and recommendation.  The district court has 120 days to make the decision.

“The Court recommends that Sheriff McMahon’s Motion to Dismiss be DENIED. The Court also recommends that Sheriff McMahon’s request for summary judgment be DENIED without prejudice to its renewal after he has an opportunity to exercise his discretion whether to deny a license to Plaintiff on grounds other than lack of good moral character.  Finally, the Court recommends that Plaintiff’s Motion for Summary Judgment and request for an order requiring Sheriff McMahon to issue a license be DENIED without prejudice to reconsideration after Sheriff McMahon exercises his discretion to grant or deny same.”

Update July 30, 2014 – Lots more activity.  In a nutshell, this case is a mess. Birdt has filed a motion for summary judgment and the Sheriff has filed his opposition the centerpiece to which revolves around a California State Bar suspension which led the Sheriff to conclude that Birdt lacks good moral character which is one of the prerequisites to obtaining a California CCW.  The hearing is tentatively scheduled for August 12, 2014.

Update May 27, 2014 – Lots more activity:

“On May 13, 2014, the Court issued an Order requiring the San Bernardino
Sheriff’s Department (“SBSD”) to produce to Plaintiff and to the Court by June 2, 2014
Plaintiff’s application file for a concealed weapon permit, including all records
concerning the reasons for its denial and identifying all SBSD personnel involved in
reviewing and/or denying the permit. The Court also ordered SBSD to indicate what
hearing and/or appeal procedures exist to challenge the denial and submit any readily
available statistics regarding concealed weapon applications. The Court further issued an
Order to Show Cause why Plaintiff is not entitled to a hearing and/or appeal procedure to
challenge the denial of his permit. SBSD was ordered to file its brief by June 16, 2014
and Plaintiff was permitted to file any response by July 15, 2014.
In its Opposition to Plaintiff’s pending Motion for Summary Judgment, SBSD
requested the Court to withdraw its May 13, 2014 Order. The Court sees no reason to do
so and declines SBSD’s request. The Court expects SBSD to comply with its May 13,
2014 Order. Indeed, the Court does not intend to rule on Plaintiff’s Motion for Summary
Judgment or SBSD’s attempt to move for same in its Opposition until after the
information required by the Court’s May 13, 2014 Order is produced and the OSC is
resolved. In fact, the Court previously indicated that Plaintiff may wish to consider
withdrawing his MSJ and amending his complaint until after the process required by the

May 13, 2014 Order is completed. That process may generate significant new facts and
legal determinations that will render the existing First Amended Complaint and pending
MSJs inappropriate as a basis for resolving Plaintiff’s Second Amendment claim. The
Court wants the best record available before doing so.”
