LOST ON APPEAL!

The only recourse for Baker now is an appeal to the United States Supreme Court but given the procedural posture of this case, an appeal would fail.

 

Baker v. Holder 13-56454

Baker v. Holder is a misdemeanor domestic violence case in which the Plaintiff had his conviction expunged and despite 10 years having passed, the DOJ says he is ineligible to possess a firearm.  The district court judge twice dismissed his case with prejudice.  The case is now on appeal.  It will be interesting to see how the current appeal does given that one of the mitigating factors for upholding the Federal law in US v. Chovan, was that a person could have his conviction expunged and his eligibility to possess a firearm restored.  Here is a link to many of the case filings.

We are currently waiting to see if the case will be remanded to the district court.

The Baker v. Holder – Opening-Brief is due February 17, 2016.  Filed February 16, 2016.

An Errata to the Opening Brief was filed on February 17, 2016.

The Answering Brief is due April 15, 2016. Filed on April 15, 2016.

The Appellant’s Reply Brief is now due on May 27, 2016.  Filed on May 27, 2016.

This case is now fully briefed.  We now await oral arguments (if any) and a decision.

Update by Charles Nichols, President of California Right To Carry – November 1,  2016 – The decision in this case was issued very quickly.  Baker lost.  More than that, the Court held that case was incapable of being amended (which normally would allow for a do-over under the procedural posture of this appeal) citing the failure of Baker’s attorneys in the district court below.  Moral of the story is not to hire these attorneys should you find yourself in a similar predicament.  Because of Baker’s poor choice of lawyers, he is forever barred from raising the same claim again (for all intents and purposes).  Fortunately for those who are in this predicament, the decision is unpublished which means that only Baker is permanently screwed.

Update by Charles Nichols, President of California Right To Carry – October 7,  2016 – The NRA lawyer did not do very well in oral arguments this morning.  Senior 9th Circuit judge Stephen S. Trott skewered the NRA lawyer for being unable to articulate an “as-applied” challenge which would warrant a remand back to the district court despite the NRA lawyers having over three years to prepare one. When it came time for the government lawyer to speak, the government lawyer spent eight minutes telling Judge Trott just how brilliant he is and then sat down.
