This appeal of the denial of a preliminary injunction had been stayed pending resolution of Baker v. Kealoha.  This appeal was stayed pending resolution of several cases.  The last one to be resolved is Baker v. Kealoha.  Instead of waiting for Baker v. Kealoha to be decided, the court unanimously affirmed the denial of the preliminary injunction.  The Court awarded costs to the Appellee on September 7, 2016.

The NRA can now do one of four things: 1) File a Cert Petition with SCOTUS, 2) File an en banc petition with the 9th Circuit or 3) Continue to argue the case in the district court and appeal the inevitable final judgment or 4) Agree to dismiss its case in the district court.

The Plaintiffs chose door number 1.  See December 29, 2016 update below.

Post Appeal Proceedings – No Cert Petition Filed

The case now returns to the district court assuming no further appellate action is taken and the mandate issues.

It returned to the district court after losing on appeal.  The Plaintiffs have now appealed to the US Supreme Court.  There Cert Petition is due on January 5, 2017.  Justice Kennedy turned down their latest request for an extension of time to file the petition.

McKay v. Hutchens is a virtual clone of the Peruta case brought by the same NRA state organization, the California Rifle and Pistol Association (CRPA).  The motion for a preliminary injunction against the Sheriff of Orange County (Hutchens) was denied.  The NRA/CRPA appealed.  Oral arguments were heard in the appeal and the case taken under submission for a decision.

After the NRA/CRPA’s improper motion to enter my case as an Amicus (in which the NRA/CRPA asked the court to stay my case) the 3 judge panel in Mckay stayed their appeal pending a decision in Chovan, Peruta, Richards and Baker (Karma is a bitch).  After decisions were published in those cases, the NRA/CRPA filed a motion asking that the stay of its appeal be lifted and a memorandum opinion be filed in their favor.  On April 23, 2014 the three judge panel issued an order denying the NRA/CRPA motion.  The appeal remains stayed pending further order of the court.  The district court proceedings were also stayed pending the appeal of the denial of the preliminary injunction by the district court.  Let this be a lesson to those who think the Peruta decision is somehow binding on other CCW cases.  The threshold for granting a preliminary injunction is only “likelihood of success.” The threshold for winning in the district court is much higher.  Even with this low threshold for issuing a preliminary injunction and coupled with the Peruta decision, two of the three judges assigned to the McKay appeal do not think there is a likelihood that the NRA/CRPA will ultimately win its case against Sheriff Hutchens.

In short, this case is stuck in the mud pending the en banc proceedings in Peruta, Richards and Baker (the en banc petition in Chovan was denied).

Update by Charles Nichols, President of California Right To Carry – February 1,  2017 – Neither side has filed a notice with the district court that the cert petition was never filed.  The parties were supposed to notify the district court (within 10 days) of the outcome of the appeal.  They didn’t.  As such, the district court proceedings remained stayed indefinitely until one of the parties asks the district court judge to resurrect it.  Courts are not allowed to enter indefinite stays but what can I say?  37 – District Court Order Staying Case

Update by Charles Nichols, President of California Right To Carry – January 5,  2017 – The US Supreme Court still requires paper cert petitions and briefs to be filed and for them to be filed by 2:00 pm Eastern Time at the Court.  Theoretically, the cert petition could have filed by US Mail or commercial carrier provided it was mailed today for delivery within three days.  Given the complex, anal retentive, hyper-technical requirements the court imposes on cert petitions and briefs, many firms hire a professional legal printing service to print and file their briefs.  In any event, the deadline for filing the cert petition in this case has now passed.  I will post a link to the cert petition if and when I get my hands on a copy.

Update May 7, 2015 – The appeal is going to remain stayed until the following cases are resolved.  So far, US v. Chovan (cert denied) is the only resolved case although the en banc decision in Peruta could erase the Second Amendment framework given to us in Chovan which could be disastrous.

Update February 20, 2015 – The appeal is still in limbo and this isn’t the only “right to carry” case being stonewalled by the 9th Circuit.  There is one case that was filed just after the Heller decision which was published in June of 2008 which is still languishing on appeal.
