Update March 17, 2015 – The notice of appeal was filed on March 11th.

Update February 26, 2015 – The district court has upheld the handgun roster and did so citing the Peruta decision.  The district court judge made this outrageous conclusion.  “The Second Amendment does not protect guns, but rather conduct.” This was an interesting conclusion from the district court judge in his decision.  The district court itself said that Heller used a First Amendment analogy.  Well, under judge Mueller’s logic California could ban all books except those which it lists on its approved roster of books because the First Amendment does not protect books, but rather reading.

The Heller Court, of course said that “[T]he Second Amendment extends, prima facie, to all instruments that constitute bearable arms…”
