Michael Vogler v. City of Pasadena et al - Concealed Carry - Case Dropped

In light of the en banc decision in Peruta v. San Diego, this case was voluntarily dismissed 633 days after it was filed.

Michael Vogler v. City of Pasadena et al

I’m only adding this case because Mr. Vogler filed a motion to intervene in the Peruta v. San Diego en banc case and, because, it just so happens to be assigned to the same district court judge (S. James Otero) who presided over my Open Carry case.  Otherwise, this is just another run of the mill concealed carry case.  There won’t be much to update as the district court case is effectively stayed, on Judge Otero’s own motion.

Update June 14, 2016 by Charles Nichols – President of California Right To Carry – I wonder if judge Otero is going to defy the US Supreme Court and the 9th Circuit Court of appeals and grant a concealed carry permit in this case.  His scheduling notice makes no sense otherwise.  But then again neither does judge Otero.

Update March 21, 2016 by Charles Nichols – President of California Right To Carry – The status report was filed on March 15, 2016.  The scheduling conference is still scheduled for Monday, March 28th.  Given that there is unlikely to be an en banc decision in Peruta v. San Diego before then, the case is likely to remain stayed.  Note that this case has been in the district court for a year and a half, there have been 58 docket entries and the case still has not progressed beyond the case management conference let alone a scheduling order for discovery and dispositive motions (e.g., summary judgment).  Judge Otero seems to dislike being a judge.  A pity Congress is too lazy to give him the boot.

Update January 25, 2016 by Charles Nichols – President of California Right To Carry – The presiding district court judge (Otero) has, for all intents and purposes, extended his stay by pushing back the scheduling conference which was scheduled for this morning to March 21, 2016. EDIT – pushed back again to March 28, 2016.
