The Plaintiffs Voluntarily Dismissed Their Case Effective November 30, 2016

Fyock et al v. The City of Sunnyvale et al

This lawsuit challenges a magazine ban enacted by The City of Sunnyvale – Municipal Code section 9.44.050.  Here is the Complaint.  Many of the filings with the court can be read here for free.

On March 27, 2014 the district court proceedings were stayed pending a final disposition of the appeal of the denial of a preliminary injunction.  On April 2, 2015 the Plaintiffs notified the district court that they had lost their appeal (14-15408).  The Plaintiffs did not file a cert petition with SCOTUS (they did file a writ with Justice Kennedy which was denied).
