Ronald Nordstrom v. Geoff Dean

This is yet another concealed carry lawsuit in which Jonathan Birdt is the attorney.  With only 46 docket entries, there have already been seven notices of deficiencies to Mr. Birdt for deficient filings.  Notably, Birdt has filed a deficient amended complaint AND a deficient motion for summary judgment.

According to the First Amended Complaint (FAC), Nordstrom was denied a concealed carry permit (CCW) because he failed the “good moral character” requirement under state law.  What he did to fail that requirement, the FAC does not say.  Attorney Birdt himself was denied a concealed carry permit for failing the good moral character requirement of the state law and has lost a string of concealed carry lawsuits for others as well.  I guess he figures that if he keeps trying that eventually he will win one.

San Diego decision.  After which, the court will rule on the motions for summary judgment and the motion to dismiss.  As this is a concealed carry case, the district court judge will have no choice but to dismiss the case with prejudice.  Let’s see if Attorney Birdt decides to take his case to the Supreme Court.

Update by Charles Nichols, President of California Right To Carry – March 29,  2016 – Note that the following is basically a cut and paste from Birdt’s concealed carry lawsuit Christopher Anderson et al v. John Scott et al status of March 25.  The eponymous attorney Jon Birdt keeps making the same mistakes.  One would think he would learn from past mistakes but no.  There has been some activity since the district court stayed this case (see March 11, 2016 update).  Mr. Birdt filed a motion to lift the stay of his case (Dkt #43).  If you are familiar with Mr. Birdt’s cases, it should come as no surprise that the court filed yet another notice of deficiency to one of his filings (Dkt #44).  This is Mr. Birdt’s seventh notice of deficiency for this case and this case is just getting started.  Mr. Birdt’s request to lift the stay was denied (Dkt #46).

MINUTES OF IN CHAMBERS – ORDER STAYING CASE PENDING EN BANC RULING BY THE NINTH CIRCUIT by Judge Dolly M. Gee: The Ninth Circuit has taken up the case of Peruta v. Cty. of San Diego, 781 F.3d 1106, 1107 (9th Cir. 2015), and the related case of Richards v. Prieto, 782 F.3d 417 (9th Cir. 2015), for rehearing en banc. The cases were argued and submitted on 6/16/2015, and have not yet been decided as of the date of this Order. The outcome of these rehearings is likely to be dispositive in the outcome of this case. In the interest of conserving the parties’ and the Court’s resources and preventing inconsistent rulings and requests for reconsideration that may ensue, the Court sua sponte exercises its prudential authority to stay the action pending the issuance of an en banc opinion regarding Peruta and Richards. The parties shall file a joint status report within 15 days after the Ninth Circuit acts on the Peruta or Richards cases. The pending motion for summary judgment [26] and motion to dismiss [30] are held in abeyance for the duration of the stay. Court Reporter: Not Reported. (gk)
