It has been 343 days since this case was filed!

The appeal is stayed pending disposition of Montana House Bill 273 which would presumably render the case moot if it becomes law.

Well, the Second Amendment Foundation has once again proved that a definition of insanity is doing the same thing over and over again while expecting a different result each time.

Or perhaps the head of the SAF, Alan Gottlieb, knows that he is going to lose but files these concealed carry lawsuits to entice the Kool-Aid drinkers to give him money.  I don’t know.

In any event, the same lawsuit was filed with a different plaintiff in Missouri and lost (Plastino v. Koster).  This time, the lawsuit (Knutson v. Curry) was filed in Montana, which is in the 9th Circuit.

Both states are Open Carry states.  The plaintiffs in both cases are not United States citizens who seek concealed carry permits claiming that they have a right to concealed carry permits under the Second Amendment.  Ironically, an equal protection claim which is not based on the premise that there is a Second Amendment right to carry weapons concealed in public could win.  But that wasn’t the argument in either case and as a result, this latest lawsuit is going to lose for the same reasons the prior lawsuit (and every other concealed carry lawsuit has lost).  Quoting from the judge in the first case (Plastino v. Koster):

“[T]he Court finds that this case does not involve a limitation on a Second Amendment right. The Supreme Court has stated that “the right secured by the Second Amendment is not unlimited. From Blackstone through the 19th-century cases, commentators and courts routinely explained that the right was not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.” District of Columbia v. Heller, 554 U.S. 570, 626 (2008). The Supreme Court noted that “the majority of the 19th-century courts to consider the question held that prohibitions on carrying concealed weapons were lawful under the Second Amendment or state analogues.” Id. Indeed, the nineteenth century Supreme Court agreed, noting in dicta that “the right of the people to keep and bear arms . . . is not infringed by laws prohibiting the carrying of concealed weapons.”” Robertson v. Baldwin, 165 U.S. 275, 281-82 (1897). — Plastino v. Koster, No. 4:12-CV-1316 CAS. (April 24, 2013)

“Plaintiffs also argue that they will suffer irreparable harm absent an injunction, because not being allowed to carry a concealed firearm “causes a profound loss of a sense of one’s security, to say nothing of the irreparable harm resulting from a successful criminal attack.” See Doc. 27 at 10-11. The Court also finds this argument unavailing. First, Mr. Plastino admits that he and other noncitizens in Missouri are allowed to openly carry guns and have guns in their homes. Non-citizens are not prohibited from owning and carrying guns; they are prohibited only from carrying concealed guns. The Court fails to see the logic as to why Mr. Plastino, or any non-citizen, would feel more secure carrying his gun concealed, as opposed to carrying his gun in the open. In their reply memorandum, plaintiffs list a number of municipalities where open carry is not allowed and, therefore, plaintiffs’ attorney argued at the hearing, there are areas in the state of Missouri where non-citizens would not be allowed to carry a gun at all. Mr. Plastino, however, did not state in his declaration that he frequents or even intends to visit these specific municipalities. There is no evidence in the record that members of the SAF are located in these municipalities, either. Plaintiffs also presented no evidence, as opposed to mere argument, that carrying a concealed firearm prevents “criminal attacks,” as they suggest. What is more, the argument that Mr. Plastino might be the victim of a criminal attack, and that he could thwart that criminal attack if only he could carry a concealed gun, as opposed to openly carrying a gun, is nothing short of pure speculation.” — Plastino v. Koster, No. 4:12-CV-1316 CAS. (April 24, 2013)

Here is the Complaint in Knutson v. Curry.  Here is the Complaint in Plastino v. Koster.  Note that they are virtually identical, paragraph by paragraph, and the SAF attorney did not even try and correct any of his mistakes pointed out by the judge in the first lawsuit.

Ironically, this case could result in nobody in Montana being able to obtain a concealed carry license because of prior 9th Circuit precedent, Silveira v. Lockyer, 312 F. 3d 1052 – Court of Appeals, 9th Circuit (2002) and had the Complaint instead challenged the Montana law based on alienage, it would have had a much better chance of winning.  But it didn’t.  The Complaint argues that there is a Second Amendment right to carry a concealed handgun and denying persons who are not a US Citizen from obtaining a concealed carry permit violates their right to equal protection which is a very different claim from one simply based on alienage.




Update by Charles Nichols, President of California Right To Carry – March 25,  2017 – Montana House Bill 273 was in the process of being enrolled on March 24, 2017.  The parties are required to file a joint status report no later than 30 days after the end of the current legislative session.  As of today’s date, no status report has been filed.

Update by Charles Nichols, President of California Right To Carry – December 19,  2016 –  I hadn’t planned on checking the docket until the end of the month but since a brief in another concealed carry case was due today I went ahead and checked the docket only to discover that today the plaintiffs filed for a preliminary injunction.  Although the plaintiffs no doubt hope the preliminary injunction is granted for the duration of the case the reality is that if the preliminary injunction is issued then it will be stayed pending a decision by the court of appeals.  And if the preliminary injunction is appealed then the district court proceedings are very likely to be stayed which means the plaintiffs will have to wait a year or so for a decision by the court of appeals.
