Mahoney v. City of Seattle – Do Police have 2A Rights? 14-35970


It has been 999 days days since this case was filed!

It has been 826 days since the appeal was filed!

It has been 623 days since the reply brief was filed!

Mahoney v. Lynch (formerly Holder in the district court), now Mahoney v. City of Seattle on appeal, raises seven questions on appeal (see the Appellants’ Opening Brief).  Two interesting questions are:

Does the fundamental right of self-defense extend to police
officers?

Does the Fourth Amendment provide compelling standards to
define the boundaries of police officers’ right of self-defense?

My view is that police officers are agents of the state when enforcing the law and as such, they do not have a Second Amendment right, which is a right of The People and not the State.  Also, people who assist police officers are also agents of the state and subject to the same limitations.  This limitation is longstanding.  It is doubtful that the court of appeals will even reach the Second Amendment questions.

But we’ll have to wait and see what the 9th Circuit Court of Appeals has to say.
