Update by Charles Nichols, President of California Right To Carry – January 23,  2017 – The en banc petition is published.  The Fourth circuit concluded that if you are in a “forced encounter” with police (such as being pulled over for a traffic violation) then you have no fourth amendment rights.  This decision creates multiple SCOTUS Rule 10 splits with the Fourth Amendment which makes it a perfect candidate for review by SCOTUS. Most Fourth Amendment cases reviewed by SCOTUS involves drugs, this one is about searching a person (a passenger in a car) over a seatbelt violation.  En banc decision
